Conditions of participation and privacy policy for the Halloween competition

1. Competition

The Halloween competition is organised by Li-iL GmbH Arzneimittel Arzneibäder (hereinafter: the provider). The Halloween competition is offered subject to availability. The provider reserves the right to extend, change or shorten the Halloween competition without giving reasons. In such a case, participants are not entitled to any claims against us. The provider also reserves the right to exclude participants from the Halloween competition in the event of suspected abuse, manipulation or criminal behaviour. There is no legal entitlement to participate in the Halloween competition.

2. Participation

(1) All persons over the age of 18 may participate. Employees of the provider and their relatives are excluded.

(2) Participants from abroad are entitled to participate, but must be able to provide a billing or delivery address from the following countries: Germany, the Netherlands, Belgium, Austria, Italy or Ireland.

(3) A person enters the Halloween competition by purchasing the bath salts "The Secret of the Ghost Villa" in the Dresdner Essenz Online Shop and fully agreeing to receive the one-off special newsletter on 31 October 2024. The participant is responsible for the accuracy of his/her e-mail address.

(4) Multiple participation in the Halloween competition is possible by purchasing several bath salts "The Secret of the Ghost Villa"

(5) The winning code can only be redeemed on this page on 31 October 2024, from 00:01 to 23:59. Transmission of the winning code outside this period or the specified link is not permitted and there is no longer any entitlement to the prize.

(6) A prerequisite for participation is that the data is entered by the participant. Participation via a service provider who enters the data of its clients in competitions - a so-called competition entry service - is not permitted.

3. Realisation & processing

(1) An individual prize code is printed on the inside of the lid of the bath salt "Das Geheimnis der Geistervilla", which can only be entered here on 31 October 2024. The participant must keep the lid with the printed prize code until 31 October 2024. In the event of a win, the participant will be asked to upload a photo of this winning code. A total of 900 bath salts with a winning code will be sold, of which 8 bath salts will carry the code with the main prize, an €80 voucher for the Dresdner Essenz online shop. After entering their code, the 8 winners will be directed to a special page where they will be asked to enter their contact details in an online form and upload a photo of their winning code printed on the product.

(2) The prize will be sent to the postal address given on the form. In the event of any uncertainties or queries, employees of the provider are authorised to contact the winner using the contact details provided.

(3) Legal recourse and payment of the prizes in cash are excluded.

4. Data protection

(2) The personal data of participants processed as part of this Halloween competition includes:

  • Contact data (e-mail address of the participants in the one-off special newsletter)
  • Inventory data (names and postal address of the winners)
  • Usage data (time of participation in the Halloween competition)
  • technical data (e.g. IP address, device information)
Participants' personal data is processed in particular for the following purposes:
  • Provision and realisation of the Halloween competition,
  • Contacting the winners and transmitting the prizes
  • for security purposes.

(3) The legal basis for obtaining consent is Art. 6 para. 1 sentence 1 lit. a) and Art. 7 GDPR, the legal basis for the processing for the implementation of the Halloween competition and the fulfilment of our associated services is Art. 6 para. 1 sentence 1 lit. b) GDPR. 1 lit. b) GDPR, the legal basis for processing to fulfil our legal obligations is Art. 6 para. 1 sentence 1 lit. c) GDPR and the legal basis for processing to protect our legitimate interests is Art. 6 para. 1 sentence 1 lit. f) GDPR.

(4) If we disclose data to other persons and companies (processors or third parties) as part of our processing, transfer it to them or otherwise grant them access to the data, this will only be done on the basis of legal authorisation. This applies, for example, to the transfer of data to third parties if this is necessary for the fulfilment of the contract (in particular for the transfer of prizes to the shipping service provider), if you have given your consent, if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.). If we commission third parties with the processing of data on the basis of a so-called "order processing contract", this is done on the basis of Art. 28 GDPR.

(5) The data processed during participation in the Halloween competition will be deleted or blocked as soon as the purpose of the storage no longer applies and the deletion of the data does not conflict with any statutory retention obligations. The participants' data required for the special newsletter will be deleted after the Halloween competition has been completed. The retention period for commercial and business letters is 6 years for the winners' data that must be retained for legal reasons. In addition, the data of the main winner will be stored on the basis of our legitimate interests (proof of the granting of the exploitation rights and, if applicable, for the assertion, exercise or defence of legal claims) in accordance with Art. 6 para. 1 sentence 1 lit. f) GDPR for as long as the exploitation rights are exercised and will only be deleted after the final discontinuation of the exploitation.

(6) Participants have the right, upon request and free of charge, to receive information about the personal data that we process about them. Furthermore, participants have the right to rectification of incorrect data, restriction of processing and erasure of their personal data and, in the event of the assumption of unlawful data processing, the right to lodge a complaint with a supervisory authority. Participants can also revoke their consent with effect for the future.

(7) Participants also have the right to object to the future processing of data concerning them in accordance with Art. 21 GDPR. In particular, an objection to data processing for the purpose of direct advertising is permitted.

(8) The provision of personal data for participation in the Halloween competition is neither legally nor contractually required. Participants are also not obliged to provide us with personal data as part of this Halloween competition. However, if they do not do so, they will not be able to take part in the Halloween competition, as this requires the provision of the above-mentioned data.
